1. Definitions
“Website” refers to all websites under the “gay4play.nz” domain.
“Online Resources” refers to online sites, tools, stores or other publicly available resources directly offering services on behalf of Gay4Play. Online resources (such as merchandise sites) may have their own terms, conditions & policies linked on their sites. In the event of a conflict between these Terms & Conditions and that of an online resource, the online resources’ policy will prevail.
“Us”, “we”, and “Gay4Play” refer to Gay4Play.nz, a New Zealand-based event & business directory website aimed at the New Zealand male gay community.
“You” and “your” refer to the user of or advertiser on our “website” and “online resources”, and recipients of our email newsletters.
“Previous terms & conditions” refer to any previous website terms & conditions contained in any document used by you and purporting to have contractual effect.
“These terms & conditions” refer to these terms & conditions overriding any “previous terms & conditions” from the Effective From date above.
2. Acceptance of terms
These terms and conditions govern all use of our website and online resources available by us to you. They are effective from the Effective From date above and will replace all earlier Gay4Play Website terms & conditions.
We reserve the right to change these terms and conditions by notice to you. Notice may be given by posting the revised terms and conditions on our website. Significant changes to terms and conditions will be posted on our website 14 days before they take effect.
By continuing to use this website and/or do business with us, we deem you to have agreed to these Terms & Conditions.
A breach or violation of any of these Terms & Conditions will result in an immediate termination of any accounts with us, removal of your listings or advertisements on our sites, refusal to serve you in the future, and possible legal action.
3. Using our website
Our website contains suggestive language and imagery, and links to Adult (R18) events, groups, businesses, and other entities. Some of these links may include adult content, nudity, or other material not suitable for people under 18 years of age. You must be 18 years or older to use this website and by confirming on the site entry pop-up that you are 18 or older and continuing to use the site, we deem that you are 18 or older.
You may not use our website or online resources for:
any illegal action or purpose that would violate any laws in your jurisdiction or ours (including but not limited to copyright and privacy laws etc.).
transmitting any worms or viruses, malware, or any code of a nature that is destructive, or is designed to interfere with or prevent normal operations of ours or any system across the internet;
any kind of harassment, bullying, defaming, or threatening behaviour or behaviour that could lead to physical or emotional harm;
any action or purpose that compromises the security of ours or any system across the internet.
You must not attempt to damage, scan, probe, profile, interfere with, attack, inject into, or harm any part of our technical infrastructure. Automating any interaction with the website is forbidden.
We will do our best to make sure the website is always available. The website may occasionally respond slowly or go down due to maintenance or very rarely due to a failure by our hosting provider. Gay4Play takes no responsibility for any data corruption, the relative slowness or unavailability of the website, or the consequences of either.
We may collect and hold information about you from our website. Refer to our Privacy Policy.
4. Intellectual Property
All Intellectual property rights of this website belong to us with the exception of logos, graphics, tag lines or other material owned by our advertisers.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Website, our Intellectual Property, our advertisers’ Intellectual Property, use of the Website, or access to the Website or any contact on the Website, without express written permission by the copyright owners. This includes but is not limited to images, articles, product descriptions, and other resources.
5. Advertisers
All information included in listings must be accurate, honest, and complete.
All listings and communications made through the Gay4Play website must be made in good faith.
Advertisers must be located in New Zealand.
You must be the copyright holder of, or licensed to use any photos, logos or other material you supply to us for the website. By supplying us with such material, you confirm that either;
you are the copyright owner and give us permission to use such materials or;
you have permission from the copyright owner to supply us with such materials and allow us to use them.
We reserve the right to refuse, withdraw or terminate any advertising service at any time; for example, where we change a category on the website or redefine the design of the website. We may also withhold, suspend, restrict or terminate any advertising service at any time. We may edit or refuse to publish material at any time if we consider it to be unauthorised; in breach of our terms, conditions, or policies; misleading; offensive; defamatory; illegal; or detrimental to the standing of our website in the community.
We do not guarantee any particular placement on any page on the website unless we specify this, nor do we guarantee that any service we provide will be continuous or fault-free.
You must not list anything that is illegal, stolen, speculative, unsafe, or may be offensive to us, to the website’s users, or to other advertisers.
You must not list anything that violates copyright or intellectual property rights.
We reserve the right to final judgement on suitability of supplied listings & content for the website.
As an introductory offer, all website listings and inclusion in email Event Notifications will be free until 28/02/2026.
6. Applicable Law and Jurisdiction
All Terms, Conditions, Agreements and Policies on our Website shall be governed by and construed in accordance with the laws of New Zealand.
Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms & conditions, or with the use of our Website or supply of any products or services.
Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.
7. Liability Limitation
Gay4Play provides an online platform for New Zealanders and New Zealand businesses to find and list businesses, events, and social groups by and/or for the gay male community. We do not participate in any transactions between users and advertisers using the website, nor do we act as an agent for any party. Therefore we take no responsibility for transactions between users and advertisers. All contact between users and advertisers is conducted entirely outside of Gay4Play and will be governed by the advertisers’ own terms, conditions and policies.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our Website.
Any liability and responsibility of Gay4Play regarding your use or misuse of our services or inability to use our services is excluded without limitation. Any liability and responsibility of Gay4Play regarding any and all loss or damage is excluded without limitation.
Liability shall be limited to the value of the transaction or direct losses caused by Gay4Play. We accept no liability for indirect losses.
8. Endorsements and Third-Party Material/Links
Content, products and services available via our Website include materials from advertisers and other third-parties. Third-party links on this site will direct you to third-party websites that we do not control.
Some third parties will be endorsed by us if specified (such as with the eggplant icon). Endorsements from us solely denote a verification of the legitimacy of the business and its operation as advertised. It is not an endorsement of the owners, operators or staff themselves or their personal opinions or views.
All other external links are not endorsed by us and these are provided only as supporting materials as part of advertisements. No specified update or refresh date applied on the Website should be taken to indicate that all information on the Website has been modified or updated with the exception of Terms, Conditions, Agreements, or Policies where specified.

If you have a complaint regarding our websites or online resources provided by Gay4Play, you should provide us with details of your complaint by emailing keen@gay4play.nz and include the word complaint in the subject line.
11. General Conditions
If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.
If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.
Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.
We may deliver notices to you by sending them to an email address that you have notified to us.
